By ticking the Terms & Conditions Box on your purchase you agreed that you have read and understood the following. If you don’t agree with any of the below, please do not purchase the ticket as you will be bound to these Terms & Conditions.

Event Waiver & Horse Health Declaration

Everyone (yes everyone) that comes to the gathering must have a completed waiver form.  If you are ​bringing a horse you will also need to complete a Horse Health Declaration.  The forms required for entry can be located by Clicking Here.

Terms & Conditions

Thank you for your interest in participating in Cowgirls Gathering.

Before you proceed to purchase tickets, we strongly recommend you go through the following terms and conditions.  If you don’t agree with any of the following, do not go ahead with the transition as the following will be binding.

By opting to purchase, allocate or possess tickets to Cowgirls Gathering, you automatically agree to our terms of use and entry. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not purchase tickets or try to enter the Cowgirls Gathering event premises.

Please note that Cowgirls Gathering reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected on the website of the organiser www.CowgirlsGathering.com.au. These changes will relate back to the date of purchase of Cowgirls Gathering tickets.  The price of one Cowgirls Gathering ticket can be found in our “shop”, this figure is non-negotiable.

Cowgirls Gathering has a strictly NO DOGS policy. This includes the camping area. A violation of this will ensure you being asked to leave the premises.

Cowgirls Gathering has a NO BYO Alcohol Policy. Alcohol may be purchased on site from our licensed providers.

The ticket you purchase represents a revocable license for you to access Cowgirls Gathering on Thursday 28th of September from 12 noon to Monday 3rd of October at 12 noon, when Cowgirls Gathering is scheduled to be hosted. The license includes the revocable right to attending the Cowgirls Gathering. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.

The bearer has to assume full responsibility of the Cowgirls Gathering tickets, once (s)he receives it. Cowgirls Gathering has no liabilities – financial, legal, or otherwise – in case the delivered tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.

Cowgirls Gathering has a NO NOISE policy from 12 midnight. This applies to Thursday, Friday, Saturday and Sunday nights. This includes music, general noise and the use of generators. We do this for the comfort of our patrons and surrounding residents; any violation of this will result in you being asked to leave the event.

Kindly note that Cowgirls Gathering is the sole authorised source for purchasing Cowgirls Gathering tickets. If you obtain your ticket(s) from any other unauthorised source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. The issuer has the right to dishonour such stolen/counterfeit tickets and declare them as void.

Cowgirls Gathering tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).  Please note that Cowgirls Gathering tickets cannot be redeemed against cash, credits, or any other benefits.

Cowgirls Gathering has the right to investigate if there has been any violation of the Cowgirls Gathering ticketing terms and conditions. In case of any conflicts, the decision of Cowgirls Gathering will be deemed final (i.e., the issuer will remain the final arbiter in cases of disputes).

The event service will be deemed to have been delivered in its entirety as soon as Cowgirls Gathering starts on Friday at 9am. From that point on, no refund requests will be entertained. Arrival to Cowgirls Gathering event is after 12 noon Thursday and no entrance will be granted prior to this. The event ceases at 5pm Sunday.

If you are not able to access any particular section(s) of the venue – Cowgirls Gathering – due to delays, federal regulations, organiser policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will not be eligible for any refunds or future credits.

If Cowgirls Gathering is cancelled in its entirety due to any unforeseen circumstances, Cowgirls Gathering has the sole and absolute right to i) reschedule the event, or ii) issue a partial/full refund, or iii) not issue any refunds.  Please note that the decision of the issuer in such cases will be deemed final and binding.

If Cowgirls Gathering is cancelled due to any factors or causes not in the control of the issuer, the latter will offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state announcements, strikes, delays in production, and the like. Once again, the decision of Cowgirls Gathering will be considered final.

In the event of an official lockdown due to COVID – 19, Cowgirls Gathering will offer a full refund to ticket holder if the alternative date does not suit the ticket holder.

If Cowgirls Gathering has to be rescheduled to other dates, you will not be eligible for any refunds. In case the event is fully cancelled, the refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.

Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, have to be borne by the purchaser. Cowgirls Gathering cannot be, in any way, held liable for that.

All ticket sales are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations.

Cowgirls Gathering is a ‘rain or shine’ event. By purchasing the event tickets, you automatically confirm that you/the attendee(s) are of the ‘minimum age’ or older, at the time of buying the ticket(s). The ‘minimum age’ for attending Cowgirls Gathering is 1 year old.

If it is proven beyond doubt at the venue that an attendee is below the ‘minimum age’, (s)he will not be granted entry to Cowgirls Gathering. No refunds, full or partial, will be issued either.

At the time of entering the event venue, you are required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.

By purchasing Cowgirls Gathering tickets and presenting the same at the venue, you give your consent to Cowgirls Gathering to collect certain information about yourself (name, picture, date of birth, gender, address, etc.) for verification and storage.

You hereby agree to forego all types of surcharge claims – full or in part – and all claims & entitlements related to it.

Cowgirls Gathering does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

Cowgirls Gathering follow a common ‘zero-tolerance policy’ towards unauthorised drug usage or carrying at the venue, AND towards any type of behaviour/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at Cowgirls Gathering and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.

Please note that you purchase Cowgirls Gathering tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.

In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final. In case a dispute cannot be resolved, the help of an independent third-party arbiter will be sought.

There will be accommodation available/given on Sunday evening but the event officially closes at 5pm on Sunday.

Self-Camping means you are to BYO (bring your own) equipment/gear/camping supplies. You will be directed to your camp site and agree to follow the directions of the event organiser. Self-Campers will have UN-POWERED site.

Food Vendors/Trade Stalls/Pop Up Shop/Retailers agree to pay the full amount to secure their site. Vendor agrees to follow directions given to their site allocation. Vendors agree to the bump in and out times given by Cowgirls Gathering. Vendors agree to remove their own rubbish from their site and agree to leave the site as they found it. Vendors agree to be open and available to patrons during the event hours from 12 noon Friday the 30th of September to 4pm Sunday 2nd of October 2022, unless otherwise agreed upon. Vendors agree to provide relevant Insurance and Licences to Cowgirls Gathering prior to the event start date

Any cancellations by Vendors must be made in writing prior to 30th of June. A full refund will be given. After this date, no refund of deposit/payment will be given if vendor cancels. This allocation is final and non-negotiable.

Class Breath and Ice - Safety and Contraindications

For those that have purchased a ticket to the Class “Breath and Ice” the following is the Safety and Contraindication that has been accepted on ticket purchase.

Safety and Contraindications – We discourage people to perform the breathing techniques and cold exposure practices in case of epilepsy, Raynaud’s syndrome type II or pregnancy. For any serious health conditions please first consult your doctor.  If you have the following health conditions please consult your doctor first.

Heart problems, or high blood pressure
Kidney failure
Angina Pectoris
Raynaud’s syndrome (type I)
Migraines
Panic disorder
Cold urticaria
Severe asthma
Acute somatic and viral diseases
Chronic obstructive pulmonary disease (COPD-II and COPD-III)
Chronic diseases with symptoms of decompensation or terminal illness
Individual intolerance of oxygen insufficiency
Cancer
Epilepsy, pacemakers or heart arrhythmias

By purchasing this ticket, you CONFIRM that you have read and agree to the Safety and Contraindications.

You acknowledge, appreciate, and agree that:

AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings and further agree to follow any oral instructions or directions given by Jo Spies or the employees or representatives of Jo Spies. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately. I declare that I will always apply the techniques taught, including but not limited to breathing exercises and physical exercises, in a safe environment (e.g. sitting on a couch/floor) and unforced. I will never practice the techniques before or during diving, driving, swimming, taking a bath or any other environment/ place where it might be dangerous to faint. I understand that breathing exercises have a profound effect and should be practiced in the way it is explained.

ASSUMPTION OF THE RISKS. I recognize on behalf of self, spouse, heirs, estate and assigns that the risk of injury from the activities involved in this program is significant. I recognize that severe injuries, including permanent paralysis or death can occur in sports or activities involving height or motion, the activities including but not limited to breath work, meditation, training routines with ice/cold/ heat, physical exercises pertaining but not limited to yoga, swimming, running, climbing, and hiking and may be caused by terrain, facilities, temperature, extreme cold, ice baths, weather conditions, condition of participants, equipment, vehicular traffic, breathing exercises, lack of hydration, or other factors. Potential injuries include but are not limited to heart failure, loss of consciousness, and stroke and may be caused by terrain, facilities, temperature, extreme cold, ice baths, weather conditions, condition of participants, equipment, vehicular traffic, breathing exercises, lack of hydration, or other factors. While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury still does exist.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF Jo Spies or others such as volunteers and trainers, and I assume full responsibility for my participation. I acknowledge and understand that while participating in the activity of Jo Spies I may be injured, physically or mentally, or may die. My personal property may be lost, damaged or stolen at no responsibility to Jo Spies or any of its agents. Other participants may cause me injury or may damage my property · The conditions in which the activity is conducted may vary without warning. I may be injured or die or suffer damage to my property as a result of the negligence or breach of contract.There may be no or inadequate facilities for treatment or transport in case of an accident and/or injury.I assume the risk of and responsibility for any injury, death or property damage resulting from my participation in the activity.

RELEASE. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Jo Spies, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event, for ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property arising out of my presence upon any facilities where Jo Spies related program and/or training is taking place, whether caused by the fault of myself, Jo Spies or other associated third parties, to the fullest extent permitted by law.

INDEMNIFICATION. I agree to indemnify and defend Jo Spies against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my use of the facilities made available by Jo Spies.

NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing.

ARM’S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arms’ length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either “for” or “against” a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other application of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

PHOTOGRAPH LICENSE. I understand while participating in this activity, I may be filmed or photographed. I grant a license to the activity organizer and affiliates to use my photo, video, or film likeness to be used for any legitimate purpose.

CANCELLATION POLICY. Upon filling this form out it is acknowledged that an invoice will be sent on receipt of payment to the listed email address.

GOVERNING LAW. This Agreement shall be governed and interpreted in accordance with the laws of Australia, QLD,(without regard to the choice of law or conflicts of law principles). In the event of a dispute arising out of or in any way relating to this document or Jo Spies to which it refers, jurisdiction and venue shall be the courts of QLD and only in those courts. The parties irrevocably waive any objections or defenses based on lack of personal jurisdiction, improper venue, or forum non convenience. To the extent allowed by law, the parties waive their right(s) to a jury trial in any action arising out of or in connection with this document or Jo Spies to which it refers. The parties further agree that any claims, disputes, or actions of any kind shall be resolved individually and without resort to any form of class action.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS
